The Principal Development Officer, (PB), outlined the application, including the showing of plans and photographs to the Committee and summarised the key issues. He referred to the Committee update, (previously circulated), which contained details of:-

1. Representations from the Hayle & District Chamber of Commerce in support of the application, and retailers.

2. Two further letters of objection and officer comment.

3. A list of points set out in the report at paragraph 60 that should be regarded as not being made.

4. Consultation responses from the Cornwall Wildlife Trust and Council Ecologist.

5. Further clarification and information from the Applicant.

6. Assessment and amended Recommendation.

The Principal Development Officer confirmed that the Council’s Ecologist continued to object to the proposal. He further advised of key changes to the scheme since the previous refusal, detailed as follows:-

1. Reduction in floor space.

2. Change in retail goods to bulky goods.

3. Confirmation the proposal was sited outside a flood zone and no objections had been received from the Environment Agency.

4. The scheme had been significantly amended to address the previous refusal on cumulative impact.

The Principal Development Officer recommended that authority be delegated to the Head of Planning and Enterprise to approve Application No PA16/03519 subject to referral to the National Planning Case Unit, the completion of a Section 106 Agreement and conditions as set out in the Committee update and report.

Councillor Pollard, (Adjoining Electoral Division Member), made the following points in support of the application:

1. Vision for the future had always included the growth of Marsh Lane, the relationship with the town would be complemented by the development of the site.

2. The previous 2 proposals for the site had been supported by the Hayle Town Council.

3. The development would provide a clear division of growth between Hayle and Angarrack.

4. There were safeguarding elements that could be put in place to protect wildlife.

5. There would be no negative impact in respect of flooding if the site was developed.

Councillor Coombe, (Electoral Division Member), made the following points in support of the application:

1. The application had been previously refused for only one reason; retail impact, the applicants had addressed this point and amended the scheme.

The Senior Development Officer, (ECB), outlined the application, including the showing of plans and photographs to the Committee and summarised the key issues. He referred to the Committee update, (previously circulated), which contained details of a consultation response received from Wendron Parish Council concerning the visual impact and concern on the neighbouring small rural community.

The Senior Development Officer advised of an amendment in the report and confirmed the proposal was sited 250 metres from the road.

The Senior Development Officer recommended that Application No. PA16/04953 be approved subject to conditions as set out in the report.

Mr Richard Jenkins attended the meeting, was permitted to speak, spoke in support of the application and answered questions put by Members.

Councillor Jenkin, (Electoral Division Member), made the following points in relation to the application:

1. Issues had been raised by local residents in regard to the impact on the open area of landscape and the view from houses of a ‘grey area’.

2. The landscape could be enhanced by adequate screening to be planted in keeping with natural species.

Councillor Bastin, (adjoining Electoral Division Member), confirmed there were properties within his Division which were influenced by the design and he confirmed he would be supportive of additional screening.

Following the presentationsthe officers responded to Members’ questions regarding:-

1. As part of the screening for the area discussion could take place with the Electoral Division Member to ensure adequate screening was planted.

A full and detailed debate ensued, the main points of which were noted as follows:-

1. A number of certain species had limited growth and were not appropriate to be grown in the area.

Arising from consideration of the report and debate it was moved by Councillor Webber, seconded by Councillor Chamberlain, and on a vote of 15 votes in favour, 1 against and 3 abstentions, it was:-

RESOLVED that Application No. PA16/04953 be approved subject to conditions as set out in the report including the additional condition not in the original permission in relation to the planting of appropriate screening in keeping with the natural landscape, in consultation with the Electoral Division Member.

The reasons given by the Proposer for wishing to approve the application were that:-

1. Subject to appropriate mitigation and the recommended conditions, the proposed development was considered to be acceptable in relation to policies.

2. The development would assist in contributing towards renewable energy generation, maximizing environmental and economic benefits whilst minimising adverse local impacts.

Hybrid Planning Application Comprising: Outline Planning Application (All Matters Reserved apart from access) for 5.44ha of Land for approximately 103 dwellings, extension to Kingdom Hall for additional parking, 2,500m2 of allotments, provision of school drop off with turning facilities including additional parking for allotments, in addition to footpath / cycle connection from Mountside Road to Lamellyn Road and detailed application for 86 no residential dwellings with associated access roads, footways, parking, landscaping, drainage and open spaces.

The Principal Development Officer referred to page 96 of the report which contained details in regard to the Public Inquiry due to be held in March 2017. He referred to main changes to Phase 1 of the Scheme, as detailed in the Committee update and recommended that authority be delegated to the Head of Planning and Enterprise to approve Hybrid Application No. PA16/04955, subject to conditions as set out in the report and Committee update.

Councillor Roy Taylor, (Adjacent Electoral Division Member), and on behalf of the St Blaise Town Council, made the following points in relation to the application:-

1. Concern that according the County Records Office there were a high number of mine adits located in the area of the site.

2. Development of the site would increase the risk of flooding upstream of the site, including the properties located within Manor View.

3. Concern that the additional traffic would add pressure to the existing high volume of traffic around the school and would add to safety issues.

4. The additional development would increase pressure on the local infrastructure including increased capacity on the NHS and doctors surgery.

Following the presentationsthe officers responded to Members’ questions regarding:-

1. In response to concern raised in regard to surface water management issues, further drainage technical matters, including drainage below ground into the mining adits, it was confirmed that the matters were raised with the Environment Agency and he referred to mitigation measures, as outlined in the Conditions 20 Parts A & B as set out in the report.

2. The landowner was normally responsible for mine adit water.

3. The drainage design meets critical robust design as set out in the proposed amended conditions.

4. In response to a question regarding exploration of the speed of water flows off site, it was confirmed that the implementation of drainage systems could manage water in a more sustainable way, investigations were needed to see where the water was going.
